We are off to a good start in 2024, announcing the publication of the article “Open Finance” by Carmen Pastor Sempere, Lead Researcher at LegalCripto (Prometeo 2023, CIPROM/2022/26) in issue 80 of the journal Cuadernos de Derecho y Comercio (pages 18-59), published by the Fundación Notariado.
The article discusses the new legal framework for financial data exchange in European law designed to drive the digital transformation of the European financial sector while maintaining consumer security and trust. It explores the possibilities and limitations of the regulatory instruments, both those already adopted and those proposed, and their coordination with the crypto-assets, access to financial data, digital identity and payment services regimes.
